Can Dealership Refuse PDI Before Registration? Know Your Legal Rights

One of the most frequent dilemmas car buyers face in India is when a dealership sales representative claims: "PDI is only allowed after RTO registration and full payment." This statement is misleading and puts the buyer at severe commercial risk.

1. The Legal Reality Under Indian Consumer Law

Under the Sale of Goods Act, 1930 (Section 41) and the Consumer Protection Act, 2019, a buyer has an explicit right to examine goods before accepting delivery. Once a vehicle is registered with the RTO in your name, the car legally belongs to you and the dealer cannot simply replace it if major defects, transit repaints, or engine issues are uncovered later.

2. Why Dealerships Push for Registration First

Dealerships often have sales targets and stockyard aging quotas. If a car was scratched during transport from the manufacturer plant or stored in an open yard during monsoon storms, dealers prefer registering it to a specific buyer so the customer has no recourse but to accept warranty touch-ups instead of a defect-free unit.

3. How to Insist on Your PDI Inspection

  • Put it in writing: When booking, write on the booking receipt: "Vehicle allocation subject to satisfactory independent Pre-Delivery Inspection (PDI) before RTO registration."
  • Withhold final disbursement: Do not authorize the bank loan disbursement or pay the remaining 90% balance until you receive an official PDI report.
  • Request VIN and stockyard visit: Legitimate dealers will readily escort you or your professional Metro Car PDI inspector to inspect the vehicle in daylight at their yard.

4. What If Deficiencies Are Found?

If minor issues like dirt or missing mats are noted, the dealer can rectify them before delivery. However, if structural damage, odometer tampering, or repainted doors are identified by a digital paint thickness gauge, you have the full legal right to reject that particular Vehicle Identification Number (VIN) and request another allotment.
